Settlement Offer- Without Prejudice

I’ve been given the opportunity by the MA at Service Canada to withdraw my CPPD appeal at tribunal general division. There is no explanation of the breakdown other than the timeline of the earliest year 2021 Dec, 4 month wait period. Payments start April 2022.

Is it fairly safe to accept this offer and withdraw my appeal?

I have taken into account overpayments which started roughly in October 2024. So there’s still a nice lumpsum and I have the DTC, to account for the years.

Having done many of these settlements, i can say that 99.999% of the time it is safe to accept the offer if the start date they are suggesting sounds correct. I can’t advise on your specific situation. However, these settlement offer are really just a claim approval - not a settlement in the sense you would see in a LTD or personal injury claim. The reason they have to do this as a settlemetn offer, is because once you file the appeal with the SST, they can no longer unilaterally approve your CPP disability claim without your agreement. It is normal for them to give you the paperwork to sign to remove your case from the Tribunal as part of this settlement. If you have concerns, you could ask for a settlement conference with a tribunal judge to have them review it. Also, the settlement does not include any specific amount of benefits. The benefits get calculated after the settlement when it goes back to Service Canada for processing. The only thing in the agreement is the date of disability onset.
