I’m having an argument with a LLM. Does a LTD insurer have a legal right to ask for the CPP-D application itself? I know I must tell them if I get approved for clawback, but what about the Doctor and Applicant side application to service canada?
Well legally they can ask for almost anything. Whether or not you have an obligation to provide it is likely an “it depends” scenario. You can prove your claim without providing the CPPD stuff, but if it goes to litigation you may have to provide it if it’s relevant to the lawsuit.
My insurer asked me for my CPP-D medical report that my doctor filled out. They said that they don’t need my doctor to fill out any more update forms if I provide the medical report that my doctor filled out for my CPP-D application. My insurer said that if I don’t provide them with my medical report for my CPP-D, they would reach out to my doctor with forms to fill out, asking about potential return to work.
I have nothing to hide, my CPP-D application states that I am unlikely to return to work, and it was easier to just provide my medical report, so I did. I redacted my SIN number on each page before sending the report to my insurer.
