Work and ltd forced to leave

I’ve been off work on ltd fir almost a year. Can my work force me to quit or resign? Will i lose my ltd?

Hi,

Once a person makes an LTD claim, it is not tied to their employment status after that point. So if you lose your employment while on LTD, it does not affect the LTD per se, unless you are classified as taking an early retirement or something to that effect.

When employers can dismiss an employee on sick leave is very fact specific. You cannot be forced to quit or resign if you don’t want to. I encourage you to read our article covering employment rights for people receiving disability benefits
