LTD. CPPD tribunal level

Hi. I receive LTD and RBC since 2021. Had both knees replaced. Having hip issues advanced Osteoarthritis. Having hand thumb surgery both hands. I have no family physician. I am now at Tribunal level and having CMC joint (thumb) surgery in 2 weeks. I am asking hand specialist to do a more detailed report with prognosis. I saw a clinic doctor and he refused to do application form for CPPD I insisted I have no doctor. He did reluctantly and rudely and I believe he wrote I could go back to work in 2 years as that is how long I m stopped for my knees rehab and ongoing hip pain. I am asking CPPD to send me the application the doctor sent. I think I need maybe a rheumatologist?? I am asking my psychologist to write a letter I see her for stress. Coping issues. Given my limitations at age 56.

Should I hire a lawyer for tribunal. Will the insurance RBC or Ltd help me. They don t give me a lot of info. What questions should I ask.

I have just notified them of the reconsideration decision. Meeting severe but not prolonged indefinitely. Waiting for their reply. Very stressed. Afraid

Advice please appreciated

My first question, does your LTD insurance get to offset any CPP disability payments you get?

I’ve seen a few people try really hard and finally succeed at getting CPP-D payments, just to later find out they are contractually obligated to give it to their LTD insurer.

Yes they do get to and I m not sure if denied and going to tribunal if they will just take amount off or stop payments ? However can not work presently still since 2020 and for at least 2 more years if ever

They can’t estimate and subtract CPP-D from LTD payments the moment your CPP-D application is denied. Unless you signed something saying you’d appeal you don’t even have to appeal a CPP-D denial to keep your full LTD benefits.

I was positive I would get denied CPP-D and my “major” insurance company tried to tell me appealing a denial is required, and I just said show me where it says that in my LTD contract and they folded and said I was right.

What would my surgeon ( he replaced my knees and put me off work for 2 years + also referred me to hand specialist. I need plastic surgery both hands ) need to write for my tribunal if he agrees to help me.

It s recognized I m severe since 2020 when I stopped work but prolonged and indefinite was not proven I was a nurse x30 years prior to having to stop work.

He s the doctor that knows me best as no family physician.

I think you need the support of any doctor.
A specialist is better IMO.
I hope the surgeon or hand specialist helps with the tribunal.

Hi. If you worked as a nurse for 30 years, do you have some doctors or nurse practitioners in your personal network who can help with the paperwork? I’m sorry you are stressed, I hope you will receive the help you need at this time.

That is a good suggestion. I believe I will try that route. Thank you
