If you have not missed the 90 day deadline, then you should file the notice of appeal right away. If you are now past the deadline, you need to file a request for an extension of time to file your appeal. This is a situation where I would encourage you to get a disability lawyer to help with the extension of time application. If that application isn’t granted, then you need to start over with a brand new application and will miss out on a large portion of your retroactive payment.
