Denied LTD for mental health, being strong armed into resigning

I went off work due to severe mental health issues resulting from workplace bullying and harassment by my immediate supervisor. The organization has turned on me and despite numerous external and internal complaints about said individual, the organization is gaslighting me. My doctor and therapist filled out LTD forms and provided letters and I was denied. Now I am being strong armed into residing. As a single mom who has gone through and overcome so much trauma and abuse I don’t know what to do. My head is spinning and my career goals have been derailed. My doctor and therapist said I cannot return under the same supervisor. My union has been less than helpful. My position is a professional one and I have worked very hard at my career. I do not know what to do or how to proceed. I don’t think I can afford a lawyer as I am going through family court for custody and I have to pay that lawyer.

Given my experience, after whats happened, I would NEVER leave. The employer must apply Duty to Accommodate and do a Return to Work plan. Your doc must do a Return to Work plan with you.

Use your iPhone and a app or whatever you have to record every interaction with your boss and with your executive Director - tell them you’re recording because you need it to help your memory and to keep things clear.

They will change their behavior because they’re afraid of what will happen if they say or do something that they have been doing all along. For example, if they refuse to have you work under another supervisor and put you with the one that’s bullying you you can say- so you knowingly will put me back under the same person that is bullying and that you know I have objected.

If the union refuses to help then you get them on failure to represent discrimination because of your disability and arbitrary action and file a complaint under the PSLRP.

I helped a friend out by recording a meeting with RCMP health services. Wow that took very little time for them to assign a new doctor.

Thank you for that information, that is helpful. So far they are refusing a back to work plan to accommodate anything. Basically if I want to go back it will be the exact same situation with no accommodation. They have letters from my healthcare team and recommendations and I just cannot wrap my head around how they think they can just ignore recommendations by healthcare professionals. I have a consult with resolute Monday and hopefully I will have more clarity on my rights.

Is it gov’t or private? It’s private you would have to complain against the employer or union using the Canadian industrial relations board bracket CIRB.

Hardship and a pain in the ass to do it but use ChatGPT that’s what I did put in all the information. I had also event timeline and previous information made. I piled it all into ChatGPT and ask it to write a complaint according to the relevant sections in the Canadian labor code and a PSLRB because I’m federal. It was a time saver and a godsend.

I should’ve complained about the union from the beginning. Ready to do it really because they know it’s very tough to fill in all this paperwork to make it through all these processes of which they are experts at. But nonetheless don’t let them get away with it. I know it’s tough. I’ve been there and it was the worst mistake I ever made to leave the workplace. Make them make it safe as my motto.

What province are you located in? Try calling your your workers compensation program, in BC they added preventing bullying to workplace safety requirements.

I think you should pursue the avenues others have suggested here, and what you learn in your consultation. I think your situation may not invoke LTD criteria. If you can do your job, but under another supervisor or with another employer, you are not “disabled” according to their definitions as you can do the job. This will be regarded as a management problem of the organization, and not a medical problem you have and will have regardless of supervisor or employer. Hope that makes sense.
