Appealing Decision- General Division

Letter of decision: CPP Disability
We are maintaining our previous decision.

What does “We recognize that you have limitations” exactly mean?
However, we have concluded that you should be able to do some type of work in the future.

Severe means under the CPP legislation:

Incapable regularly:
-Regularly means that the limitations associated with the disability are persistent, continuous and uninterrupted.

If my limitations are recognized as defined under the CPP Legislation they are contradicting themselves.
First decision was based on “future treatment”. What they weren’t aware of at that time was future treatments had already started 6 years prior to present aligning with the criteria.

Updated psychiatric assessment Oct 3 2024. Page 3.

She remains with substantial functional limitations despite reasonable efforts to treat her
underlying mental health conditions. She is expected to remain functionally impaired to the
point of inability to manage competitive employment. Her condition is expected to last
indefinitely regardless of any further treatment.
Assistance will be provided with documentation of disability in the future as needed.

Sounds like they acknowledge there are limitations but they don’t think they are severe enough to be a barrier to employment.

Thank you @jammer I sympathize with anyone struggling through these hurdles. I’m terrified to be heard at a hearing, like stage fright. In my opinion it would be my best interest to be heard but I get completely frozen and my mind draws a blank when put on the spot.

When submitting an appeal request https://sst-tss.gc.ca/en/your-appeal/canada-pension-plan-cpp-disability-appeals is this the time to submit my entire file that I put together or should I wait until I receive my file from Service Canada?

Warm regards

Is this the stage when they expect us to give up? There’s no way from the date Service Canada had received the clinical notes Dec 30th considering the weekend and holiday the decision letter is dated January 9, realistically a few days to review and make a decision???
