Currently I receive CPP Disability and LTD from insurer. Insurer informs me that my status is changing to long duration.
Not sure if anyone can answer or share an experience.
Is this typically when an employer lets go of employees for causation of trust?
Benefits/ Insurance policy says benefits paid out until I’m 65. Would these stop?
Many employers will try end your employment at the 2 year point using Frustration of Contract as the reason for termination without severance or minimum legal severance depending on province.
BUT…at the 2 year mark if it’s reasonable to assume that with continued treatment that you’ll be able to return to work in the foreseeable future then the Frustration of Contract reason can’t be used. If it is the employer has opened themselves up to wrongful termination action.
I went on Short term in July 2016 to LTD any occupation status in 2019. My contract was"frustrated" in 2023. Due to my position I received a considerable severence including full benefits for an additional year.
Insurance policy is a policy. No changes allowed unless both parties understand.
However, it is my understanding that the situation is similar to wrongful dismissal and you could negotiate the benefits with severance much more in your favour…
