Do I have the right to consent with my doctor first

I requested that my doctor (not the one who filled out the LTD paperwork) review the information he’s sending to the insurer with me first with my consent, before sending to the insurer. This doctor is saying I don’t have that right as I’ve already signed the ROI with the insurer. Is this true?

I’m not any form of legal or medical professional but that sounds ridiculous.

My doctor runs everything he sends to my insurance by me. It doesn’t mean he will necessarily make the changes I request but he doesn’t send a thing to insurance without at least consulting me.

You can revoke your consent in writing with both the insurer and the doctor and tell them you will liaise directly with the doctor to provide them with the information.

A bit of a warning, if it goes through you, you might have to pay for the doctor’s fee that the insurer might have been covering previously.

Unfortunately I did and the insurer said they would not go forward with LTD, and my doctor did not agree to my withdrawal of consent…

I usually know roughly when my insurer will be asking my doctor for an update (every 6 months etc), so I notify my doctor to look out for forms from my insurer, and I ask my doctor that once the forms have been filled out, that I can review the draft before it is submitted to my insurer. I often ask my doctor for small changes to be made and I have never had a problem with this. To my understanding, my doctor doesn’t legally have to review it with me, so I request very politely that I can go over it together. If your doctor refuses to do so, I would ask for a copy of the forms submitted to your insurer. You have a right to your own medical records, though there may be a fee involved. You also have the right to ask for corrections to be made to your medical records, so I would email your doctor with any factual errors, and request your chart to be updated. I have found doctors don’t usually like to correct a patient’s chart, but at least you will have documentation of your request for the correction. You can also forward that email to your insurer.

My situation is complex. My main disability being PTSD, and second one having long term disabling effects after being improperly tapered by the doctor. He has refused to send all email threads and only sent and out-of-context email by me to the insurer and left out the rest of the email thread (depicting me as an irresponsible patient - not true).

This doctor has been pretty cruel, also refused to abide by my request not to omit information, and for him to run it by me first - as it would be too taxing from him personally (Otherwise I don’t trust what he is sending). He said he will send a reply to the insurer saying I imposed too many restrictions on him and for that reason cannot give further information.

He knows I’m partly disabled because of his unsafe treatment protocol. It seems like he wants to protect himself and is manipulating the situation

What a frustrating situation and I’m sorry you have to go through this. A lot of great suggestions in this post and this thread in terms of strategies. Obtaining your own medical records can also be useful so you can provide and use them even if it is not from the doctors. If pursuing another provider these may also be helpful. Do you have any other providers? Psychiatrist, psychologist, psychotherapist? Can they provide information? Legal perspective as mentioned above can support more too. Good luck.

Yeah my other providers already provided info but the insurer woudn’t let me go forward with the claim after I had withdrawn consent, so now I’m forced to have him mess up my claim. He had also made unlawful privacy violation. I’m afraid terminating the relationship might also put my claim in jeopardy. And I’m not going to switch psychiatrists for reasons I can’t disclose. What a nightmare
