Hey All, so I’m submitting additional material for my request for consideration for CPPD. I have found several cases on Canlii that directly support my case and could be huge but they are related to ODSP not CPPD. Will that make a difference and hurt me if I reference those? Thanks

I’m not Ontarian but on a quick review it looks like the test for ODSP is “substantial” whereas for CPPD it’s “severe and prolonged”. You should think through whether the ODSP cases you found are relevant to the “severe and prolonged” test you need to meet for CPPD and decide from there.

Hi, cases related to ODSP will not be helpful for your CPP disability case. You need limit yourself to citing decisions related to CPP disability. This is because the ODSP decisions are made by an entirely different Tribunal and have a different legislated definition of disability and considerations.

There is a government website that posts cases of CPPD appeals. I’ll see if I can find the link. It’s very similar to Canlii.
