Hi all. My LTD claim was denied, mediation is scheduled. In the meantime I am stressing out about being surveilled (although I am doing nothing wrong - I am living within the confines of my medical condition and medical guidance).
Are PIs allowed to put a gps tracker on your vehicle? I haven’t noticed anyone watching me or following me but the paranoia is strong in this one. I’m always worried that going to a friend’s house for a couple hours will derail my claim.
It would be illegal under Canadian Criminal and Mischief laws.
It would be an absolute PR nightmare for an insurance company if the news found out that claimants were being electronically tracked.
On a side note, going to your friends house for a couple hours won’t have any impact on your mediation unless you’ve said you NEVER leave your house because your medical condition doesn’t allow for it.
I hope you are doing alright. Could you send me or repaste the answer that lawyer David posted as a response to your post? I looked for it, but for some reason, I do not see it. Thanks again, and I hope you do well with your situation.
Hi, insurers would not be able to do GPS tracking of private individuals. However, they may be able to get GPS-type data in a litigation via the discovery process. Also, it is possible to buy anonymous GPS data that can be tracked to a house so in a round about way it is sometimes possible to track a unique phones that enter and leave a house, but not have it ID to a specific person. I highly doubt insurance companies would do this. Google Wired Magazine Epstein Island Data Broker Tracking to see a wild article on how this is done!
