LTD and retirement

I have been approved for LTD from GWL for 2 years, and I’m do to retire, will I lose my LTD?

You will probably lose your ltd when you retire.
My policy says I do when I reach the age of 65 or retire.

You would need to review your policy. Many group policies end at age 65 or date of retirement, which ever happens first. However, you need to check to see what your policy actually says on this.

Good morning.

Thanx for the response. This is the letter that I had received in Nov. My dr wants to put me off completely, as she didnt want me to go back at all. I’m worried if she does and I retire during this time of being put off will I lose my LTD once I retire.

The way that I understand the letter is that I will be deducted dollar for dollar. Any assistance you can provide me with is greatly appreciated.

My policy says:

Your Long-Term Disability payments end on the earlier of the
following dates:
 the date you are no longer totally disabled.
 the last day of the month in which you reach age 65.
the last day of the month in which you retire with a pension or are
eligible to retire with a full pension or a full pension equivalent.
 the last day of the month in which you die.

Your’s may be different of course.

Where would I find this info. The letter I received only states if I am in receipt of pension I would be deducted dollar for dollar.

Are you talking about a retirement pension or a disability pension from the pension plan?
For me as mentioned above LTD stops when you receive a retirement pension.
LTD from the insurer is reduced dollar for dollar with a disability pension.
You many want to clarify which type of pension the letter is referring too.

And I found this info in my employee booklet that my employer provided.

Ask HR for the benefit booklet that was in effect when you went on LTD.

We see two types of clauses – the one like RaptorsFan posted and other would be they have the right to deduct dollar for dollar. The one like RaptorsFan is the one you have to be wary of because you will loss all payments and there is no take-backs. I had a client lose hundreds of thousand because she signed the retirement forms and then decided to call us.

Have had 2 separate issues with not receiving my LTD payments. First being end July 19. When I emailed case worker Tanya in ref as to why she replyed that there was confusion with my file on her part. I.e. Sent me for OT and after 3 sessions GWL cancelled reminder Appts due to the fact of the report that they received from the OT stating that I was not ready to go back to work and she could not help me. I have been diagnosed with PTSD, severe depression, sever anxiety, etc. this was back in June when GWL received this report.

Then again end Sept payment was not received. When I emailed case worker Tanya she replyed that it was just released and apologized for the delay. When I asked why, she replyed " I apologized " and no explanation was given. She did inform me and only after I inquired as to why was Stephanie CC’d on my email. She stated that now I have a new temporary case worker. I did ask "where’s my rights to privacy to my medical records. She responded that all GWL employees have access to my file. Is this actually legal?

She also once again sent forms for me to fill out as well as my DR. My counsellor also wrote a letter to them, stating that I am unfit for any type of work. All forms were to be sent to GWL no later then 31Oct. My Dr. Has been saying this since 1 May 2018.

I had received an email from my new case worker Stephanie stating that she wanted to make an appt with me to have an in depth telephone conversation. This has created great stress and increased my anxiety levels. My question here is do I have to talk to her on the phone, or do I have the right to ask that everything be done via email? Stephanie did say that “they were reviewing my claim for the change in definition occurring 27 August 2020”. I did email her back asking for an explanation of what this change meant. But have not received a response back from Stephanie.

Has anyone else had any of these issues with their claims?

No idea if they can say no.

A change in definition may mean that for the first 2yrs the insurance company considers you disabled if you can’t do your current job. After the change in definition the consider you disabled if you can’t do any job (at another workplace maybe) (not “any”, eg. they wouldn’t make a doctor work at Walmart). If they cut you off then I would consult a lawyer.

yes, if you have signed a release for GWL it would in theory apply to all their employees, but in reality they would still restrict it to claims people dealing with your claim.

I encourage everyone to speak with the claims people. It is normal for them to do these types of interviews by phone because it is much easier and more efficient to do it. You could speak with a lawyer for a consultation on how to prepare for and approach the interview call. Most lawyers will charge for this type of consultation.

The change they are talking about is a normal part of most group disability policies. It only means that after two years the criteria to qualify for LTD under your plan changes form disability from your “own” occupation, to disability from “any” occupation.

Is this normal protacal this far in advance to the chage in definition?
