# LTD Claim Terminated Retroactively – Can’t Afford Repayment. Next Steps?

I recently had my long-term disability (LTD) claim terminated retroactively after the insurer concluded I no longer met the policy’s disability definition. They cited an investigation that found I was enrolled in a graduate program and working part-time as a teaching assistant, which they claim contradicts my reported functional limitations (severe depression, cognitive impairments). I dispute this, as my academic/work activities are accommodated and unrelated to my prior occupation’s demands.
The insurer is demanding repayment of over $9,000 for benefits paid during the contested period. I cannot afford this. Has anyone successfully challenged a retroactive termination or overpayment demand in similar circumstances? Are there options to dispute without legal fees, or negotiate a payment plan? My mental health condition complicates navigating this alone. Any advice on next steps would be appreciated.

I agree that you’ll need to get a lawyer to see if they can help. based on the limited information you have provided it’s going to be an uphill battle.
For others reading this, ALWAYS ALWAYS ALWAYS involve the insurer BEFORE starting any type of retraining or part-time work while receiving LTD payments.

Yes, I think it will be an uphill battle. Let’s see what the free legal consultation says. I just don’t have the money now and I don’t know how I will pay it back.
